EU court: 'OPENAI' too generic to trademark
The EU General Court upheld a refusal to register 'OPENAI' as a trademark, ruling it merely descriptive of open, AI-related software and cloud services.
The court found the term combines “freely accessible” and “AI” in a way that merely describes the service rather than identifying its source, the standard EUIPO test for descriptive marks. OpenAI holds the trademark in more than 30 other countries.
