Judge voids Anthropic's Pentagon label

A federal judge ruled the Pentagon's supply-chain risk label on Anthropic was unlawful retaliation, vacating the designation and barring its enforcement.

U.S. District Judge Rita Lin ruled Thursday that the Pentagon’s decision to label Anthropic a national security supply-chain risk was “unlawful retaliation in violation of the First Amendment,” and that Anthropic was denied the pre-deprivation process required under the Fifth Amendment. The ruling vacates Defense Secretary Pete Hegseth’s designation and bars federal agencies from enforcing it.

The dispute started earlier this year when Anthropic refused a Pentagon request to strip safety guardrails from Claude that block its use in autonomous weapons targeting and mass surveillance of U.S. citizens. Hegseth’s department responded by ordering federal agencies to stop working with the company, citing an undefined supply-chain risk. Lin found the government never produced evidence Anthropic actually posed one. Anthropic still has a second, related suit pending in D.C., so Thursday’s win settles this specific designation but not the broader fight.

What it means for you

If your company sells software or models into federal agencies, this ruling is the first real data point on how far the government can go in punishing a vendor for refusing a security-relevant request. A judge just said “not this far” in fairly blunt terms, which raises the cost of using procurement leverage as a pressure tactic. It also lands right after Anthropic’s own compute build-out with Nscale, a reminder that the company is scaling for enterprise and government demand simultaneously, even while fighting the government in court over how that access gets used.
